Home building insurance exemptions for public sector work

Posted by Fair Trading NSW on 2 October 2018

A new exemption for home building compensation (HBC) cover is now in place which allows NSW public sector agencies to decide whether or not to cover the project with HBC.

If you're a builder or tradesperson contracting with a public sector agency you must check for an insurance exemption clause in the contract.

If the contract does not specify that the new exemption of section 103E of the Home Building Act 1989 is being relied upon and no other exemptions apply, you will need to obtain HBC cover.

More information about HBC cover exemptions is available on the State Insurance Regulatory Authority website.
